TERMS AND CONDITIONS OF SALE — SELHYAN

ARTICLE 1 — SELLER

ARTICLE 2 — ACCEPTANCE

Any order placed on the website constitutes unconditional acceptance of these Terms and Conditions. The applicable Terms and Conditions are those in effect on the date of the order. Selhyan reserves the right to modify them at any time.

ARTICLE 3 — PRODUCTS

Selhyan offers two types of products, as specified on each product page:

  • Made-to-order: crafted according to the size and options selected by the customer at the time of ordering.
  • Ready-to-wear: in stock, ships immediately.

The images on this website are for illustrative purposes only. Slight variations in color due to display settings do not constitute grounds for a complaint. For handmade items, variations in color, texture, or finish may occur and contribute to the unique character of each item.

If an item is out of stock after an order has been placed, the customer will be notified and will receive a full refund or a store credit of equal value, at her discretion.

ARTICLE 4 — PRICE

Prices are in euros, including tax, excluding shipping costs, which are displayed before checkout. Selhyan reserves the right to change its prices at any time; the applicable price is the one displayed at the time of confirmation.

Sale items are sold at the listed price and cannot be returned or exchanged.

For shipments outside the European Union, customs duties, local taxes, and import fees are the sole responsibility of the customer, who is solely responsible for declaring and paying them to the authorities in their country.

ARTICLE 5 — ORDER

The order is confirmed when you click "Confirm Order." A confirmation email will be sent immediately. Any changes made after confirmation are subject to Selhyan's approval.

Selhyan reserves the right to refuse any order for legitimate reasons (suspected fraud, unusually large quantities, obvious pricing errors, or failed payment).

ARTICLE 6 — PAYMENT

Payment by credit card (Visa, Mastercard, CB) via a secure SSL interface. Payment in 3 installments with no fees is available through Klarna, subject to approval by Klarna. Selhyan does not have access to any banking information. The charge is processed upon order confirmation.

ARTICLE 7 — RETURNS AND CANCELLATIONS

7.1 Custom-made and made-to-order items

In accordance with Article L221-28(3) of the Consumer Code, these items—which are made to the customer’s specifications—cannot be returned, exchanged, or refunded, except in the case of a proven manufacturing defect attributable to Selhyan.

7.2 Sale items and one-of-a-kind items

Sale items and one-of-a-kind pieces are not eligible for exchange or store credit. The 14-day legal right of withdrawal applies only to standard in-stock items; after this period, no returns or exchanges will be accepted for these items.

7.3 Ready-to-wear items in stock (excluding sale items and one-of-a-kind pieces)

The customer has 14 calendar days from the date of receipt to exercise her right of withdrawal (Article L221-18 of the French Consumer Code), by email to customerservice@selhyan.com. Any return without Selhyan’s prior approval will be refused.

Requirements:

  • Item has never been worn or washed; tags are still attached; it is in its original packaging.
  • Return shipping costs are the sole responsibility of the customer, regardless of the country of shipment.
  • Selhyan accepts no liability for any loss or damage that may occur during the return process.

Options after the return has been approved:

  • Store credit or exchange: no additional fees.
  • Refund: Processed within 14 days of receipt and inspection of the package, via the same payment method. If you do not receive your refund within 15 business days, please contact customerservice@selhyan.com.

7.4 Withdrawal Form

ARTICLE 8 — CUSTOM ORDERS AND BRIDAL

Orders for wedding dresses or fully customized items are non-returnable, non-exchangeable, and non-refundable, except in the case of a proven manufacturing defect attributable to Selhyan.

  • A non-refundable deposit is required at the time of booking. Once paid, no cancellations or substantial changes will be accepted.
  • The balance is due before shipment.
  • Measurements are provided by the customer at her own risk. Selhyan cannot be held responsible for a poor fit resulting from an error in the measurements provided. In such cases, no returns or free alterations will be offered.
  • Any issues must be reported within 48 hours of receipt, along with supporting photos.
  • A "substantial" modification refers to any change affecting the design, materials, colors, or measurements by more than ±1 cm.

ARTICLE 9 — WARRANTIES

The products are covered by the statutory warranty of conformity (Articles L217-4 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code).

The warranty does not cover damage resulting from improper use, improper maintenance, modifications made by the customer, normal wear and tear, or accidents. Selhyan reserves the right to reject any claim that does not pertain to a manufacturing defect that existed prior to delivery.

For any complaints, please contact customerservice@selhyan.com with detailed photos and a description of the defect.

ARTICLE 10 — LIABILITY

Selhyan shall not be held liable for any failure to perform its obligations in the event of force majeure (strikes, natural disasters, pandemics, government restrictions, carrier failures, etc.). Deadlines are suspended for the duration of the event.

ARTICLE 11 — INTELLECTUAL PROPERTY

The SELHYAN trademark (No. FR5022955) and all content on this website are the exclusive property of KDI SAS. Any unauthorized reproduction constitutes infringement.

ARTICLE 12 — PERSONAL DATA

The data collected is processed by KDI SAS for the purpose of fulfilling orders and managing customer relationships, in accordance with the GDPR. To exercise your rights: customerservice@selhyan.com. ARTICLE 13 — DISPUTES

In the event of a dispute, please contact Selhyan first. If an amicable resolution cannot be reached within 30 days, you may file a complaint with the FEVAD e-commerce mediator (60 rue La Boétie, 75008 Paris — www.mediateurfevad.fr) or through the European platform: https://ec.europa.eu/consumers/odr

ARTICLE 14 — GOVERNING LAW

French law. Competent French courts. Mandatory consumer protection provisions applicable in the customer’s country of residence within the EU remain applicable if they are more favorable.
